83-year-old arrested for DUI after hitting bicyclist

A 37 year old bicyclist was  injured in a Ponte Vedra car accident, which officials say was caused by a suspected  drunk driver. According to a news report by First Coast News, the major injury collision occurred the night of August 30, 2012 in the 300 block of Ponte Vedra Boulevard. Officials say a vehicle, driven by an 83-year-old man, struck the bicyclist.  The bicyclist was taken to Baptist Hospital with serious injuries.  The driver of the vehicle was arrested on suspicion of DUI. According to Florida Department of Highway Safety & Motor Vehicles, in 2009 there were no alcohol related fatalities, but 20 injuries reported as a result of DUI crashes in St. John’s County.

Based on this news article, it appears that the driver of the car was under the influence at the time of the collision. According to Florida Statute 316.193:  A person is guilty of the offense of driving under the influence and is subject to punishment …if the person is driving or in actual physical control of a vehicle within this state and the person is under the influence of alcoholic beverages.
